The Future of Your Neighborhood Is in Your Hands
for two reasons.
ONE: a new Board of Directors for the HOA will be elected November 13. Some of the veterans are stepping down and we need to replace them. The new Board will elect Officers at an organizational meeting in December. We hope several of you would be willing to serve for a year in some capacity, of course, but we also need at least 30 percent of Owners (22) for a quorum to transact the Association’s business at the Annual Meeting.
TWO: Equally important, the Board needs approval of Policies and Procedures required by the passage of Senate Bill 100 last year. Every HOA in Colorado is to have these in place by Jan. 1. We have been working with the law firm of Orten & Hindman to bring our documents into compliance with State law.
Unlike most Colorado HOAs , our Bylaws require a vote of 51 percent of Owners (37) to adopt such rules and the Annual Meeting is our best chance to get sufficient turnout for passage. (Incidentally, O&H recommends removal of this language from our Bylaws because it hamstrings the Board’s ability to act quickly on the Association’s behalf).
Our Covenants and Bylaws already contained many components of the required policies.
The required Policies and Procedures are these:
Enforcement (including a fine schedule)
Collection of dues and assessments
Conflicts of Interest
Investment of Reserves
Conduct of Meetings
Inspection of Records/Document Retention
Adoption of Policies
We hope to have the Policies and Procedures completed in time to share them with you all electronically. If that is not available, we will share the questionnaire that we returned to O&H with our responses.
If they don’t pass? Any Owner can bring an action against the Association (and that’s all of us, not just the Board) for failure to fulfill its fiduciary duties by not complying with the law.
Please remember: HOAs use Covenants to:
- maintain, preserve, enhance and protect the property values and assets of the community.
- promote a harmonious community.
- preserve the common scheme and harmonious design of the community.
PLEASE attend the Annual Meeting, November 13, 1-3 p.m. at the Hot Tub or San Lazaro Clubhouse (depending on weather) ORbe sure to get your proxy to another Owner.
